Many of Nozick's assumptions are simply described as truthiness.  Truthiness is
Stephen Colbert's satirical term used to describe things that a person claims to
know intuitively or "from the gut" without regard to evidence, logic,
intellectual examination, or facts.(1) [ASU starts out with truthiness in the
intro about things we may not do without violating rights, non-examination of
rights, marriage example, etc.]

Distraction from the further gut feelings that rights should not be used as excuses for other abuses, and should be limited.  Gut feelings that that man should not be allowed to beat his horse or dog or wife or children.  Or be allowed to forget to constructively use his land (adverse posession.)
